The Chicago Lawyers' Committee for Civil Rights Fair Housing Project identified two potentially discriminatory ads for the same property posted to the craigslist website in August 2005. The ads read, in part, "in clean Adult [sic] building" (emphasis added) and "In nicely landscaped, clean adult 2 flat" (emphasis added). The Chicago Lawyers' Committee filed a complaint with the Department of Housing and Urban Development (HUD) in February 2006 about the ad. After an investigation, HUD, on September 25, 2007, charged John W. Yatczyshyn, the property owner, with discriminatory advertising in violation of the federal Fair Housing Act.
HUD details the impact of such discriminatory ads in the Charge of Discrimination. It states, in part, "As a result of the Respondent's discriminatory conduct, an unknown number of prospective tenants with children were discouraged from seeking a rental opportunity at the subject property because of the discriminatory language 'adult 2 flat' and 'Adult building' in Respondent's rental advertisement, frustrating [Chicago Lawyers' Committee’s] mission to promote diverse and equal housing in the Chicago metropolitan area."
The Chicago Lawyers' Committee for Civil Rights is represented by Jeffrey Taren of Kinoy, Taren & Geraghty, P.C.
